Provisional Patent Revisions Empty Provisional Patent Revisions

Hello
We have a provisional patent that needs revised, because ours does not show that it is claiming the most up-dated technologies that need to be claimed. It is over the 90 days now since we filed.

The advanced technologies we want to claim is not ours, can we claim them in our provisional patent application?

You can always file a new provisional application or wait until you convert to a utility application to add new materials into the provisional if the the changes are less significant. In your case, if the new technology is a substitute or equivalent, I would hold off and add when you convert to utility

I suggest that you file another provisional patent application just like the other one but THIS time include the new matter. When you file your NPA you can claim the priority date for the earlier stuff on the earlier one and the new stuff on the other one. If you want to see EXACTLY how to file a Provisional Patent Application take a look at the Provisional Patent Video Course by searching that term in Google or within YouTube...

Anyway.. filing a second or third PPA for $125 is CHEAP insurance.. Especially if you are in a HOT HOT HOT field like gaming or things having to do with smart phones!
