This is not legal advice. You can ask a patent attorney that deals in the toy industry. You will find that a lot of games are not patented. You do want to copyright the rules of your game, because that is normally what makes the game unique.

You can probably use both copyright and patent protection. Copyright should be available for the design of your board, and for your instructions/user's manual Patent would be available if your game is both new and usefull. Good luck, and contact a patent attorney.
